Terms and Conditions of Service


1. Authorization

By accepting towing or roadside assistance services from Pat & Jake’s Towing, the vehicle owner, operator, or their authorized agent (“Customer”) acknowledges and agrees to these terms and conditions. The Customer affirms they have the authority to request service and grant access to the vehicle.

 

2. Payment Terms

All charges for towing, recovery, storage, labor, or other services rendered are due upon completion unless otherwise agreed in writing. Unpaid balances may accrue interest and/or be subject to collection actions, including recovery of reasonable attorney fees and costs.

 

3. Service Rates

Charges for services are based on the following factors:

•            Hook-Up Fee: A standard base rate for attaching and securing the vehicle for transport.

•            Mileage Fee: A per-mile charge from the pickup location to the destination.

•            Recovery/Winching: Additional charges apply for vehicles that are stuck, off-road, overturned, or require special recovery equipment.

•            After-Hours/Weekend/Holiday Rates: Premium rates may apply outside of regular office hours.

•            Storage Fees: Daily charges apply for vehicles left on company property beyond the initial grace period of 8 hours.

•            Special Equipment/Conditions: Oversized vehicles, motorcycles, trailers, or hazardous conditions may incur additional charges.

A full rate sheet is available upon request. Rates are subject to change without prior notice, but the Customer will be informed of applicable charges before service is performed whenever possible.

 

4. Lien and Storage

Pat & Jake’s Towing retains a possessory lien on all vehicles towed or stored for unpaid charges. Vehicles left unclaimed may incur daily storage fees and may be subject to lien sale or disposal per local and state regulations.

 

5. Damage Liability

Pat & Jake’s Towing exercises reasonable care in handling vehicles. However, Pat & Jake’s Towing is not liable for:

(a) Pre-existing damage;

(b) Damage resulting from mechanical failure or concealed vehicle defects;

(c) Damage occurring due to poor road conditions, weather, or acts of God;

(d) Damage to or loss of items not secured within the vehicle.

 

6. Personal Property

The Customer is responsible for removing all personal belongings from the vehicle before towing or storage. Pat & Jake’s Towing is not liable for any personal property left in or on the vehicle.

 

7. Abandoned Vehicles

Vehicles not claimed within 10 days may be considered abandoned and subject to lien sale or disposal in accordance with state law.

 

8. Customer Responsibility

It is the customer’s responsibility to ensure accurate location details, vehicle information, and safe access for towing. Incorrect or incomplete information may result in additional charges, which are non-refundable. If the condition of the vehicle presents an unsafe situation for towing, Pat & Jake’s Towing reserves the right to refuse service or charge additional fees for special handling.

 

9. Service Limitations

Arrival times provided are estimates. Delays may occur due to traffic, weather, or unforeseen events. Pat & Jake’s Towing is not liable for losses due to service delays or cancellations.

 

10. Refund and Cancellation Policy


10.1 Cancellations

·         Once a tow truck has been dispatched, a cancellation fee will apply, even if the service is not completed.

·         If cancellation occurs before a truck has been dispatch, no fee will be charged.

·         If cancellation occurs after dispatch but before vehicle pick-up, a minimum service fee of $50 will be charged to cover time and travel.

·         If cancellation occurs after the vehicle has been secured for towing, the full service rate applies.


10.2 Refunds

·         Refunds will only be issued in cases of duplicate charges or billing errors.

·         Once towing or roadside assistance services are performed, all sales are final and non-refundable.

·         Storage, mileage, labor, or administrative fees are non-refundable once incurred.


11. Jurisdiction

These terms are governed by the laws of the state of Ohio, and any disputes arising hereunder shall be resolved in a court of competent jurisdiction within that state.
